Supreme Court Dismisses Pension Claim of Ex-Bank Employee Post-Resignation.
06 January 2025
The petitioner, a former bank employee, resigned from his position in 2001 due to personal reasons, including the need to care for his aged parents and minor children. The resignation letter, which was not disputed, was accepted, and the petitioner offered to liquidate his dues before leaving the bank. Subsequently, the petitioner sought pensionary benefits, claiming that he had completed 20 years of service, but his requests were rejected.
The petitioner's writ petitions filed in 2004 and 2015, as well as a writ appeal, were dismissed on the grounds that his resignation precluded him from receiving pensionary benefits, as the benefits were only available to those who retired voluntarily under specific conditions. The Supreme Court, upon reviewing the case, found no grounds to interfere with the lower court's well-reasoned judgment. Consequently, the Special Leave Petition was dismissed.
