Supreme Court Grants Bail to Appellant After 13 Years of Incarceration Due to High Court Delay.

The Supreme Court of India granted bail to Faim at Kayyum, who had been incarcerated for 13 years, in Criminal Appeal No. 632/2020. This appeal stemmed from a conviction under various sections of the Indian Penal Code (IPC) and the Arms Act, related to First Information Report (FIR) No. 428/2011. The Court took this action because the High Court of Madhya Pradesh had failed to hear the appellant's appeal despite previous orders from the Supreme Court. 

 

 
 
 

The Supreme Court overturned the High Court's judgments, ordering Faim Kayyum's release on bail, with terms to be set by the trial court. The Court clarified that its decision was based solely on the prolonged incarceration and delay in the appeal process, and did not reflect an opinion on the merits of the case. The High Court was given the liberty to cancel the bail if the appellant failed to appear in future hearings.
