Supreme Court Grants Bail to Rajaram in NDPS Case, Suspends Sentence.


On 26th September 2025, India's Supreme Court, in Criminal Appeal No. of 2025 in SLP (Crl.) No. 12946/2025, released Rajaram on bail, suspending his 10-year jail term under the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985. Justices Surya Kant and Joymalya Bagchi set aside a Rajasthan High Court order of April 8, 2025, which had declined Rajaram's application for suspension of sentence and grant of bail while he had an outstanding criminal appeal.

Case Background:

Rajaram was charged under FIR No. 6/2017, dated January 23, 2017, filed at the SOG Police Station, Jaipur. Rajaram and another accused were accused of carrying 4 kilograms of poppy husk in a Bolero vehicle. On April 10, 2023, the Special Judge, NDPS Act Cases, Jaipur Metro-1 convicted him under Sections 8 and 18 of the NDPS Act and sentenced him to 10 years rigorous imprisonment and a Rs. 1 lakh fine.
Rajaram challenged the conviction in the Rajasthan High Court in S.B. Criminal Appeal No. 731/2023 and requested suspension of his sentence till the appeal. The denial by the High Court prompted his appeal to the Supreme Court.
 
 
 
 

Court's Reasoning and Decision:

The Supreme Court, after hearing senior advocate Sanjay R. Hegde for Rajaram as well as counsel for the State, observed that Rajaram had remained incarcerated for more than six years of his sentence. With the 2023 appeal still pending and a likely delay in its final hearing, and given Rajaram's previous lack of criminal history, the court deemed it equitable to suspend the sentence. Without expressing any views on the merits of the case, the bench directed the release of Rajaram on bail, subject to the production of bail bonds to the satisfaction of the trial court.

Outcome:

The appeal was dealt with, and all outstanding applications. Rajaram's bail release enables him to wait for the determination of his High Court appeal, highlighting the judiciary's resolve to uphold fairness in instances of long detention pending appeal proceedings.
