Supreme Court Imposes Conditions on Bail Grant in Rape Case, Urges Expedited Trial.


The petition challenges the Rajasthan High Court's order granting bail to the accused (Respondent No.2) in a rape case (FIR No.83/2023) filed by the victim (petitioner). The victim's statement, recorded under Section 164 of the CrPC, had some discrepancies with the FIR. Despite these, the High Court allowed bail to the accused, considering such inconsistencies. 


 

 

The Supreme Court expressed concern over the timing of the bail, noting the trial was ongoing and key witnesses, including the victim and her mother, were yet to testify. However, the Court decided not to disturb the bail order but imposed conditions such as preventing the accused from entering the victim's village and contacting witnesses. The Court directed the trial to be expedited, ideally within three months. The decision emphasized the need for appropriate safeguards during the bail period.
