Supreme Court Indicates Possible Appointment for MPSC Candidate Amid Vacancy Dispute.

The Supreme Court has noted that a candidate rejected for appointment in the selection process for Sub-Registrar Grade-I/Stamp Inspector in Maharashtra may be accommodated on one of the available posts, pending further orders of confirmation by the Maharashtra Public Service Commission (MPSC).

The issue pertains to petitioner Yogesh Sopanrao Dawale, an Economically Weaker Section (EWS) category candidate. He had moved to the Maharashtra Administrative Tribunal (MAT) after being rejected. It was in March 2024 that the Tribunal decided in his favor, but the order was challenged by the MPSC and other shortlisted candidates subsequently before the Bombay High Court (Aurangabad Bench). The High Court eventually reversed the Tribunal's order in September 2024, which led to the petitioner moving to the Supreme Court.


 

 
 
 

At previous hearings, the top court had directed the State and the MPSC to see if the petitioner could be set off against any vacant posts. In its recent affidavit, the State has informed the Court that up to 24 posts in the cadre are vacant, including two reserved for the EWS category—one general and one for women. The affidavit also added that if the MPSC recommended, the petitioner could be inducted against one of these vacancies.

Noticing the affidavit and the fact that Dawale alone is still challenging the matter, the bench of Justice Pamidighantam Sri Narasimha and Justice Atul S. Chandurkar suggested that he may be appointed, without disrupting the right of already appointed candidates. The Court made it clear that any order passed would be limited to the unusual facts of this case and would not be treated as a precedent.

The issue has been adjourned by four weeks with orders to the MPSC to take instructions and give a report on whether the appointment of the petitioner can be confirmed.
