Supreme Court Provides Relief from Arrest to Jharkhand Man in Pre-Arrest Bail Case.

In a major order, the Supreme Court has provided relief from arrest to a resident of Jharkhand, Gourav Mistri, who had moved the court seeking pre-arrest bail in relation to a criminal case filed at the Kadma Police Station in Jamshedpur.

The issue arose before a bench led by Justice Pankaj Mithal and Justice Prasanna B. Varale on September 17, 2025. The case originated from proceedings in front of the Jharkhand High Court, which had previously declined the anticipatory bail application of the petitioner.

In the course of the hearing, the petitioner's attorney filed that Mistri had conformed to the previous orders of the Supreme Court dated August 20, 2025, in the sense that she appeared before investigators and collaborated totally with the current investigation. The State of Jharkhand, which appeared by its attorney, confirmed the above fact to the court.


 
 
 
 

Considering the cooperation that was being offered by the petitioner, the bench ruled that coercive proceedings against him would not be justified. The court ruled that provided there is continued cooperation during the investigation, no coercive steps shall be taken against Mistri. It also ordered that if he is to be arrested, he is to be released on bail on terms to be decided by the arresting officer.

By making its August 20 interim order absolute, the Supreme Court de facto granted lasting relief to the petitioner, with his liberty not being curtailed provided he continues to cooperate with the police in the case. All the pending applications in the matter were also disposed of by the court.

This ruling reflects the Supreme Court's insistence on striking a balance between personal freedom and the necessity for effective inquiry, especially where the accused shows good faith involvement in the legal processes.
