Supreme Court Quashes Cross FIRs After Successful Mediation in Employment Dispute.


In Shubra P. Kandpal v/s The State of Uttarakhand & Others., the appellant appealed against a judgment passed by the High Court of Uttarakhand, which partly allowed her petition for quashing charges in a criminal case. The petition sought to quash charges under Sections 504 and 506 of the IPC, as well as Sections 3(1)(r) and (s) of the SC/ST Act. The High Court had quashed the proceedings under the SC/ST Act, but not under the IPC sections. The case stemmed from two FIRs, one filed by the appellant against her colleagues for harassment and the other by the colleagues against her, involving charges under various sections of the IPC and the SC/ST Act.


 

 

The appellant had previously filed an FIR against the respondents under Section 354-A of the IPC, and the dispute was related to a pre-existing conflict among the employees at a government college. After the matter was referred to mediation, the parties reached an amicable settlement and agreed to end the criminal proceedings. Consequently, the cross FIRs were quashed by the Supreme Court under its powers, citing the successful mediation and the desire to conclude the legal proceedings. The Court also acknowledged the mediation efforts made by the mediator and counsel.
