Supreme Court Recalls Order Cancelling Bail in Sushil Singh v. State of Uttar Pradesh, Restores Appeal for Fresh Hearing.


The Supreme Court of India, in an October 6, 2025, recent order, recalled its previous judgment in Criminal Appeal No. 2486 of 2025, which had revoked the bail granted to respondent no. 2, Vinod Singh alias Gangaram. The Court reinstated the criminal appeal for re-hearing after establishing that the respondent was not properly served with notice of the previous proceedings.

A Bench led by Justice Dipankar Datta and Justice Augustine George Masih issued the order during the hearing of Miscellaneous Application No. 1764 of 2025 moved by Vinod Singh for modification of the Court's previous order dated May 6, 2025. The previous order had set aside the grant of bail by the Allahabad High Court in Criminal Misc. Bail Application No. 46805 of 2024.


 

 

On perusing the office report of March 29, 2025, the Court observed that even though the May order had noted that respondent no. 2 was served, the record indicated that he was not actually provided with a copy of the notice and appeal papers. The Bench thus held that Vinod Singh was not given a chance of hearing before the appeal was determined.

Noticing this oversight, the Supreme Court remembered its May 6, 2025 order and reinstated the criminal appeal to its initial number for reconsideration. Considering that the applicant had since then surrendered, the Bench also revoked the part of the earlier order asking him to do so.

Meanwhile, the Court ordered the release of Vinod Singh on bail on terms and conditions to be fixed by the trial court. The case has been posted next for the next hearing on October 13, 2025.
The Bench ended the hearing by disposing of Miscellaneous Application No. 1764 of 2025 and ordering the registry to list the main appeal accordingly.
