Supreme Court Sets Aside Bail Condition, Orders Immediate Release of Petitioner.

The petitioner, accused in FIR No. 180/2024 under the Bihar Prohibition and Excise Amendment Act for possessing 231.6 liters of liquor, was arrested on 14.06.2024. After his bail was denied by the Trial Court, the petitioner approached the High Court, which granted bail on 25.07.2024 but imposed a condition requiring him to furnish bail bonds only after six months of custody.
The Supreme Court found no valid reason for the High Court’s condition and, in a ruling, set aside that specific part of the order. The Court directed the Trial Court to release the petitioner immediately upon furnishing appropriate bail bonds. Further conditions were imposed, including the requirement for the petitioner to be present in court on all hearing dates. Additionally, the Court warned that any future involvement in excise-related cases would be seen as a misuse of the granted bail.
All related pending applications were disposed of.
