Supreme Court Stays Insensitive Observations by Allahabad High Court Judge.

In In Re: Order Dated 17.03.2025 Passed By The High Court Of Judicature At Allahabad In Criminal Revision No. 1449/2024 And Ancillary Issues., the Supreme Court, acting suo moto based on a letter from "We the Women of India," addressed certain observations made by a Single Judge of the Allahabad High Court in a judgment dated March 17, 2025. The Supreme Court expressed strong disapproval, stating that paragraphs 21, 24, and 26 of the judgment displayed a "total lack of insensitivity" and an "insensitive and inhuman approach," which are "totally unknown to the cannons of law."
The Court noted that the judgment was not delivered impulsively but after over four months of deliberation. Despite its usual reluctance to grant stays at this initial stage, the Supreme Court decided to stay the specific observations in the aforementioned paragraphs.
Notices were issued to the Union of India, the State of Uttar Pradesh, and the parties involved in the original High Court case. The Attorney General for India and the Solicitor General of India agreed to assist the Court. Another Special Leave Petition (Diary No. 15692 of 2025) was ordered to be tagged with this matter.
The Supreme Court directed its Registrar to immediately communicate the order to the Registrar General of the Allahabad High Court, requesting the Chief Justice of the High Court to review the matter and take appropriate action. The Additional Advocate General for Uttar Pradesh accepted the notice. The case is scheduled for further hearing on April 15, 2025.
