Supreme Court Upholds Pre-2005 Land Sale in Hindu Succession Act Case.

The Supreme Court in Renavva Lakshmi & Others v/s Shantilkumarswamy R. Subramanya & Others, has dismissed a special leave petition challenging a Karnataka High Court judgment that upheld a land sale from 2003, predating the 2005 amendment to the Hindu Succession Act, 1956.
The petitioners, claiming to be legal heirs, argued their rights were adversely affected by the 2003 sale deed, citing Section 6 of the Hindu Succession Act, 1956, as amended in 2005. However, the High Court, relying on the Supreme Court's decision in Vineet Sharma vs. Rakesh Sharma (2020) 9 SCC 1, ruled that the 2005 amendment had no bearing on a sale deed executed before December 20, 2004, the date of the amending provision's introduction.
The Supreme Court found no error in the High Court's reasoning and consequently dismissed the petition.
