Tamil Nadu Medical Services Union Wins Fight for Permanent Employee Status.

The Supreme Court of India has ruled in favor of employees of the Tamil Nadu Medical Services Corporation Limited (TNMSC) in a long-standing dispute over permanent employment status. The case centred on the applicability of the Tamil Nadu Industrial Establishments (Conferment of Permanent Status to Workmen) Act, 1981 (TN Act 46 of 1981) to the Corporation and its workers.
The dispute arose when the TNMSC, a government-owned company, refused to grant permanent status to some of its employees. The Tamil Nadu Medical Services Corporation Employees Welfare Union (Union) challenged this decision, arguing that the TN Act applied to the Corporation and its workers.
The High Court initially sided with the Union, but the Corporation appealed. The Supreme Court then remanded the case back to the High Court for reconsideration of the Act's applicability.
On remand, the High Court again found in favor of the Union, determining that the Corporation did indeed fall under the Act's definition of an "industrial establishment." This meant that the Corporation's employees were eligible for permanent status if they met the Act's criteria, which they did in this case.
The Corporation appealed once more to the Supreme Court, but their appeal was unsuccessful. The Supreme Court upheld the High Court's decision, confirming that:
- The TN Act applied to the TNMSC and its employees.
- The employees in question qualified for permanent status under the Act.
- The High Court was correct in not requiring the Union to pursue an industrial dispute under the Industrial Disputes Act, 1947. The Inspector of Labour's order granting permanent status under the TN Act remained valid.
This verdict ensures that the TNMSC must comply with the Inspector of Labour's order and grant permanent employment status to the eligible employees. The Union's efforts have been successful, and the affected employees will now be entitled to the benefits and security associated with permanent positions within the Corporation.
