Telangana Forest Land Dispute: Supreme Court Examines State's Inconsistent Positions under Andhra Pradesh Forest Act.

The dispute in this case is whether the Telangana High Court judgment which set aside the concurrent judgments of the two courts below on appreciation of fact and law should stand. The Telangana High Court based its judgement on a finding that the suit property was forest land. The instrumentality of the State had taken different stands on the suit property but ultimately rectified it by way of an affidavit before the Supreme Court. This act of taking different stands resulted in the impugned order being passed in favor of the respondents. The appellants are arguing that the Andhra Pradesh Forest Act of 1967 has a laudable objective of conserving, protecting and extending the forest cover.
