Trademark Infringement Suit Against Lenskart Concludes with Swift Decree.

In TITAN COMPANY LIMITED V/S LENSKART SOLUTIONS PRIVATE LIMITED & ANR, a recent trademark infringement lawsuit filed by a well-known company against Lenskart.com has concluded swiftly, with the defendant agreeing to a decree. The suit centered on the alleged unauthorized use of the plaintiff's trademarks, TITAN and FASTRACK, on the defendant's website and within its source code as metatags.
The plaintiff, the registered owner of the trademarks, filed a suit seeking a permanent injunction to prevent the infringement and passing off of their intellectual property. Following this, a legal notice was issued to the defendants on February 13, 2025.
In a key development, the defendants, represented by counsel Mr. Nishchal Anand, conceded that the presence of the trademarks was an "inadvertent mistake." The counsel informed the court that remedial steps have already been taken to remove all references to the marks from their website. Furthermore, the defendants have committed to removing any future instances of the marks if notified by the plaintiff.
Based on this statement, the defendants chose not to contest the suit, stating they had no intention to infringe upon the plaintiff's trademarks. Accepting this, the court proceeded to decree the suit, binding the defendants to their stated commitment.
The court's decision to dispose of the suit on the first date, even before summons were formally issued, led to a notable outcome for the plaintiff. As a result, the plaintiff was exempted from paying court fees. All other pending applications related to the case have also been disposed of.
