Tribunal Ruling on Claims of Unlawful Termination: No Disputant Award Issued.

Sh. D.K. Himanshu, Under Secretary, referred two cases dated 04.07.2023 to this tribunal for review. The issue concerns claims made by Sh. Imtiyaz and Sh. Prem Pal, represented by the All India General Mazdoor Trade Union, against Sharma Enterprises, under Jamia Millia Islamia University. The claims allege that their services were terminated on 05.11.2020 and 01.09.2020 respectively, without notice, reason, or due payment, which they argue is a violation of Section 33 and 25F of the Industrial Disputes Act, 1947. The claims are pending in CGIT cum LC, No.-2, New Delhi, ID No. 155/2020.
Notices were issued to both parties, with the management's representatives attending hearings. However, the claimants have not participated or submitted their claim statements despite multiple opportunities. Due to their lack of interest in pursuing the claims, the tribunal has issued a no disputant award. The case files have been consigned to the record room, and copies of the award are sent to the appropriate government for notification under Section 17 of the Industrial Disputes Act, 1947.
