Unauthorized Use of School Name: Jaipuria Group Secures Injunction.


The Jaipuria Group, a well-known educational institution operator in India, has been granted a temporary injunction by a court against a defendant trust for using their registered trademarks without permission.

The trademarks in question are "Jaipuria International Schools" and "Seth M.R. Jaipuria School". The Jaipuria Group claims ownership of these trademarks and other intellectual property related to their educational materials and curriculum.

 

 

According to court documents, the parties had entered into a franchise agreement that allowed the defendant trust to operate a school under the Jaipuria name. However, the agreement was terminated by the Jaipuria Group due to alleged breaches by the defendant.

Despite the termination, the defendant trust reportedly continued to use the Jaipuria trademarks at their school. The Jaipuria Group then filed a lawsuit seeking to prevent the unauthorized use of their intellectual property.

The court, after reviewing the case, ruled in favor of the Jaipuria Group and issued a temporary injunction. This injunction prohibits the defendant trust from using any of the Jaipuria trademarks, including "Jaipuria International Schools" and "Seth M.R. Jaipuria School", until the next court hearing.

The court order also provides a grace period for the defendant trust to remove all references to the Jaipuria trademarks from their school premises. The deadline for compliance is July 15th, 2024.

The defendant trust has been directed to file a written response to the lawsuit by July 30th, 2024. The next court hearing in this case is scheduled for September 11th, 2024, where the judge will hear arguments from both parties and make a final decision on the matter.
