Urgent Medical Attention Ordered for Hunger-Striking Petitioner in Custody.


A writ petition was filed under Article 226 of the Constitution and Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), seeking urgent medical intervention and relief for the petitioner currently on a hunger strike since November 1, 2024, while in custody. The petition raised multiple requests, including:

Directing authorities to ensure the petitioner receives proper medical treatment at AIIMS or a super-specialty hospital in New Delhi or Srinagar.

 
 

Ensuring the petitioner's presence before the appropriate courts as required.


Revoking or addressing misinterpretations of an order dated December 19, 2023, under Section 268 of Cr.P.C.

The court issued a notice to the respondents, returnable by November 11, 2024, and directed the Superintendent Jail to provide a detailed medical report and ensure treatment in compliance with the 

Delhi Prison Rules, 2018. The next hearing is scheduled for November 11, 2024, at 12:15 PM. A copy of the order has been sent to the Superintendent Jail for action and compliance.
