Uttarakhand High Court Grants Anticipatory Bail in SC/ST Act Case.

Aditya Singh and Rajesh Kumar were granted anticipatory bail by the Dehradun court in connection with a case registered against them at Cantt Police Station (Crime No. 199 of 2022).

The duo were accused of verbally abusing the complainant with caste-based remarks and issuing threats (as per the FIR). They faced charges under Sections 323, 504, 506 of the Indian Penal Code (IPC) and Section 3(1)(X) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

 

 

This was their second attempt at securing anticipatory bail after their first application (ABA No.3327 of 2022) was dismissed in March 2023. The defense argued that the SC/ST Act shouldn't apply as the complainant didn't belong to the designated categories.

The court, after considering the arguments, granted anticipatory bail with several conditions. These include furnishing a bail bond and sureties as determined by the arresting officer, cooperating with the investigation, refraining from contacting witnesses, seeking court permission for travelling abroad, submitting passports (or providing an undertaking if they don't possess one), and undertaking to abide by the aforementioned conditions.
