The lecturer received a revised pension after retirement. However, in 2017, the government department claimed he had been overpaid ?11,54,844 and sought to recover this amount from his ongoing pension. The lecturer challenged this decision through a legal petition, arguing that he was not given a fair chance to explain the discrepancy (violation of natural justice principles). Sadly, the lecturer passed away during the lawsuit. His wife then continued the fight for her rightful family pension.

 

 

Court's Ruling:

The court ruled in favor of the wife. The key factors influencing this decision were:

  • The government department hadn't provided the lecturer with an opportunity to explain the situation before demanding repayment, which violated principles of natural justice.
  • At the time of the recovery order, the lecturer was already retired.
  • The excess payment resulted from a government error, not any misrepresentation by the lecturer.

The court's order directed the government department to:

  • Cancel the order demanding excess pension recovery.
  • Grant the wife a family pension based on the revised pension amount her husband received.
  • Repay any recovered amount or outstanding pension arrears to the wife within six weeks.
