Writ Petition Disposed: Court Refers Stay Application to CAT for Decision on 27 November 2024.

In this writ petition of Sanjay Gihar Vs Union of India & Ors., the petitioner sought a stay on two Office Memorandums (OMs) dated 07.02.2024 and 28.03.2024, to prevent any coercive actions against them until the final disposal of their case before the Central Administrative Tribunal (CAT). The petitioner also requested that the CAT be directed to expedite the disposal of the case.
It was informed that the petitioner had already filed stay applications in the ongoing OA No. 3527/2024, which were scheduled to be heard on 27 November 2024. The Court informed the petitioner’s counsel that it could not entertain the writ petition at this stage since the matter was already pending before the Tribunal. The Court, therefore, disposed of the petition by requesting the Tribunal to consider and decide the stay applications in accordance with the law on the next hearing date, 27 November 2024.
